Cancellation Terms + Conditions

The below Cancellation Terms are extracted from and make up part of the TBLDN Terms & Conditions. These Cancellation Terms apply to TBLDN’s Pay Monthly Membership packages. ‘Paid in Full’ Memberships are subject to separate terms of cancellation. MEMBERSHIPS & RENEWAL

(a)(i) Pay-Monthly Memberships

The Basement offers various Membership packages, offering a range of prices versus flexibility, so that Members have choice. Memberships that are subject to a Minimum Number of Payments and are paid monthly via direct debit (in accordance with these Terms & Conditions) are known as a “Pay Monthly Membership” or, collectively “Pay Monthly Memberships”.

For the purposes of these Terms & Conditions the:

  • Joining Date” means the date that the Member’s Membership at the Club commences;

  • Monthly Membership Fee” means the relevant monthly fee reflective of the membership package type taken up by the Member: (i) at The Basement Kentish Town: £39.99 for Classic Annual, £44.99 for Classic Monthly, £49.99 for Premium Annual; £54.99 for Premium Monthly; and (ii) at The Basement Camden: £44.99 for Classic Annual, £49.99 for Classic Monthly, £54.99 for Premium Annual; £59.99 for Premium Monthly; or another amount as otherwise agreed in writing, in advance between The Basement and the relevant Member;

  • Minimum Number of Payments” will: (i) for monthly rolling Memberships (either the Classic Monthly or Premium Monthly), equal one (1); and (ii) for annual rolling Memberships (either the Classic Annual or Premium Annual), equal twelve (12).

  • Payment Amount” means the Monthly Membership Fee to be debited from the Member’s designated bank account on the Payment Date each month;

  • Payment Date” means the date falling each month on or around the Member’s Joining Date (as set out in the payment schedule emailed to the Member at the time of joining) or another billing date otherwise agreed in writing, in advance between The Basement and the relevant Member.

A Member’s Payment Amount is due on each Payment Date. Members are obligated to make the Minimum Number of Payments as required in accordance with their Pay-Monthly Membership type.

Members are obligated to pay every Payment Amount on each Payment Date regardless of non-attendance.

Once a Member has completed the Minimum Number of Payments, the Membership will be automatically extended on a rolling monthly basis (the “Renewal Period”), with a Monthly Membership Fee continuing to be debited from the Member’s account on each Payment Date.

The Payment Amount payable during the Renewal Period may only be amended if The Basement informs the relevant Member in writing, giving not less than 30 days’ written notice before the first Payment Date where the amended Payment Amount would be applicable.

Please note if a Membership included the benefit of a free period then The Basement will stop making collections during that free period and recommence making collections on the next applicable Payment Date.

(a)(ii) Cancellation of Pay-Monthly Memberships

The Basement is not able to predict when a Member may no longer want to use their Membership, including, for example, if they are moving out of the area. Members are responsible for (1) factoring in the cancellation terms emailed to them at the time of sign-up; and (2) calculating the best date to give Valid Notice based on (a) those cancellation terms; and (b) the Member’s own personal circumstances. The Basement recommends that Members use a personal calendar or diary to remind themselves as to an appropriate date to provide Valid Notice. The Basement will not take responsibility for any non-use of Membership during the final month of that Membership (or, for that matter, any period of time preceding the final month of Membership).

All Members may prevent the automatic rollover of their Membership into a Renewal Period by submitting a Valid Notice.

Valid Notice” means a cancellation notice:

  • sent in writing via email to info@thebasementldn.com;

  • sent regards a Membership that is not frozen at the time that the cancellation notice is sent;

  • expressing the desire to have their membership cancelled;

  • providing the Member’s full name and membership number; and

  • successfully delivered to the inbox of info@thebasementldn.com.

  • Members may also complete a Cancellation Request Form to give Valid Notice.

Upon receipt of a Valid Notice:

  1. a team member of The Basement will respond to a Valid Notice to confirm receipt, usually no later than 72 hours from receipt of the Valid Notice (the “Confirmation Email”); and

  2. the Notice Period will be triggered.

The “Notice Period” is determined =

Upon receipt of Valid Notice to cancel, there will be one final Monthly Membership Fee that falls due on the Payment Date falling within 30-calendar days (inclusive) of the date of Valid Notice being given (the “Final Payment Date”). The final full Monthly Membership Fee will cover one final full month of Membership. The notice period, will therefore cover the period from (i) the date of Valid Notice being provided, and (ii) the last day of the final full month of Membership, the “Notice Period”. The Final Payment Date, and therefore final month of Membership, may not be frozen, but must be completed as an active membership in full. The Confirmation Email will confirm the Member’s Final Payment Date within the Notice Period and will confirm the final date that the Member may use the Club’s facilities.

A working example is provided below for clarity:

  • Mr Smith’s Payment Date is the 10th of each month.

  • Mr Smith sent a valid cancellation notice email on 25th November (Valid Notice).

  • The Basement sends a Confirmation Email to Mr Smith on 25th November to confirm Valid Receipt of the notice.

  • The Confirmation Email informs Mr Smith that the Notice Period has started, and that his Final Payment Date will be 10th December, because 10th December falls within the Notice Period (calculated based on 30-calendar days starting from and including 25th November).

  • As the Final Payment Date is 10th December, Mr Smith will be able to use the Club until (and including) 9th January.

  • Mr Smith’s Membership will be cancelled down and unuseable from (and including) 10th January.

  • If Mr Smith wanted 10th November to be his final Payment Date, Mr Smith should have sent his cancellation notice no later than 9th November to trigger the Notice Period.

If a Confirmation Email is not received from The Basement after 72 hours of a Valid Notice being sent, the Member is responsible for re-submitting the Valid Notice (attaching to any secondary request, evidence of previous Valid Notices made and not responded to).

When (1) the Minimum Number of Payments for the Membership type has been made; and (2) the Payment Amount falling on the Final Payment Date has been paid, the Member may only then cancel their direct debit mandate directly with their bank.

Cancellation of the direct debit facilitating the payment of Payment Amounts not in accordance with the above-described process is a breach of these Terms & Conditions.

The Basement is not obliged to refund any fees where the Member has not provided Valid Notice, or has otherwise failed to adhere to the above-described process.
